Disposition:  Affirming district court's dismissal of plaintiff's FOIA claim

  • Procedural Requirements, Entities Subject to the FOIA:  The Court of Appeals for the Second Circuit holds that "[b]ecause the defendants are not 'agencies' within the meaning of FOIA, the district court properly dismissed [the requester's] FOIA claims."  Despite plaintiff's arguments, the court finds that "Capital One is not a Federal Reserve Bank."
