Taeotui v. San Diego Registrar of Records Dep't, No. 13-2125, 2014 WL 841627 (S.D. Cal. Mar. 4, 2014) (Burns, J.)

Re: Request for "'criminal bond information"'

Disposition: Dismissing plaintiff's FOIA claim

  • Procedural Considerations, Entities Subject to the FOIA:  The court finds that "[n]either the County of San Diego, the County Clerk, or the Clerk of Court, any of which might retain the 'criminal bond information' Plaintiff seeks, is a federal agency" and "[t]he definition of 'agency' under the FOIA simply does not encompass state agencies or bodies, even if they are alleged to receive federal funds subject to federal regulation."
