  • Litigation Considerations, Exhaustion of Administrative Remedies:  The court holds that "because 'DOJ has introduced unrefuted evidence that it has no record of ever receiving an appeal from' plaintiff, it is thus 'fatal to [his] position.'"  Additionally, the court holds that "Plaintiff has failed to offer any objective evidence that DOJ or OIP ever received his notice of appeal."
