Wilson v. DOJ, No. 16-1015, 2017 WL 4155339 (D.D.C. Sept. 18, 2017) (Walton, J.)

Re:  Request for records concerning alleged confidential informant in plaintiff's criminal case

Disposition:  Granting defendant's motion for summary judgment

  • Litigation Considerations, Adequacy of Search:  "[T]he Court is satisfied that the Bureau conducted an adequate search reasonably calculated to uncover the requested records, even though its search yielded no responsive documents."  "Although not expressed exactly as the plaintiff would like . . . [defendant's] declaration provides that the Bureau searched all sources likely to uncover responsive documents[.]"  "Contrary to the plaintiff's assertion, . . . the fact that the Bureau did not uncover any responsive records despite these efforts does not undermine the adequacy of the Bureau's search and its search methods, given the extensive details outlined in [defendant's] declaration."
