This website was developed to provide information to individuals who may have been affected by the release of hazardous chemicals on October 21, 2016 in Atchison, KS.

On October 21, 2016, two chemicals were mixed at the MGP Ingredients, Inc. facility in Atchison, KS causing a chemical reaction.  This resulted in many individuals observing a cloud-like reaction that remained in the area. 

STATUS UPDATE 5/18/2020

The United States District Court District of Kansas has not been holding proceedings in the courtroom to preserve public safety and health due to the coronavirus outbreak.  After careful consideration, the Court has determined any further continuances would adversely impact the victims of this case (18 U.S.C. § 3771(a)(7)).

In an effort to permit the fullest attendance possible, the United States Attorney’s Office and the Court have arranged a telephone call-in line for those affected by the 2016 chemical gas release in Atchison, KS to hear the proceeding live.  To access this line, dial (888) 363-4749 and enter the access code 8354715#.  The line should be muted during the proceeding, however, it is best practice to always mute your phone.

NOTE: Any person granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the presiding judicial officer.

If you wish to attend the sentencing proceeding on May 27th in person at the Frank Carlson Federal Building in Topeka, KS, please notify our Victim-Witness Unit at the email and phone number below no later than 11:59pm, May 19, 2020.

•    All guests will be asked health-related questions before gaining entry into the Frank Carlson Federal Building.  If anyone answers the questions suggesting exposure to the virus, he/she will likely be turned away
•    Practice social distancing while in the building by staying at least 6 feet (about 2 arms’ length) from other people.
•    Wash your hands often. Use hand sanitizer when soap and water are not readily available.
•    Avoid touching your eyes, nose, and mouth.
•    The use of masks is encouraged by all visitors. NOTE: Some agencies may not allow visitors in their office area without masks.
