Overview

On June 6, 2016, the Department filed a statement of interest (SOI) in Doe v. Mercy Catholic Med. Ctr., 16-1247 (E.D. Pa.). The Department's SOI addressed two issues: (1) Whether a teaching hospital’s medical residency program is an“education program or activity” covered by Title IX of the Education Amendments of 1972 (Title IX), 20 U.S.C. 1681 et seq., and (2) Whether the availability of a private cause of action under Title VII of the Civil Rights Act of 1964 (Title VII), 42 U.S.C. 2000e et seq., for sex-based employment discrimination in an education program or activity precludes a private cause of action under Title IX for the same conduct.
