United States v. Biafora's Inc. (N.D. W. Va.)

Overview

On October 26, 2018, the United States filed a complaint and executed a settlement agreement in United States v. Biafora’s Inc. (N.D. W. Va.).  The election complaint alleges that the defendants, who own and manage residential apartment complexes in and around Morgantown, West Virginia, violated the Fair Housing Act by refusing to allow tenants to keep assistance animals in their homes.  The complaint also alleges that the defendants published and enforced an assistance animal policy that discriminated on the basis of disability and interfered with and intimidated individuals on account of their exercising their rights under the FHA. The settlement requires that the defendants pay $6,000 each to two individual complainants, adopt a new policy on reasonable accommodations and assistance animals, conduct fair housing training, and report to the United States on future requests for reasonable accommodations relating to assistance animals. The case was referred to the Division after the Department of Housing and Urban Development (HUD) received a complaint, conducted an investigation, and issued a charge of discrimination.
