Overview

On December 6, 2019, the court entered a consent order in United States v. TFT Galveston Portfolio LTD and James W. Gartrell, Jr. (S.D. Tex.).  This consent order resolves a pattern or practice case filed on February 21, 2019, alleging that the defendants discriminated on the basis of disability by designing and constructing an addition to the Seasons Resort property in Galveston, Texas without features of accessibility required by the Fair Housing Act and the Americans with Disabilities Act.  Pursuant to the consent order, the defendants will remove steps to provide an accessible route through the property, build a new building containing 24 FHA compliant apartments, 8 of which will contain super-accessible features, and construct a new accessible leasing office.  The defendants will also provide a $75,000 fund to compensate aggrieved persons.
