Disposition:  Dismissing plaintiff’s FOIA claims

  • Litigation Considerations:  The court finds that “Plaintiff’s last involvement in this action was on May 22, 2025, when Plaintiff acknowledged he was no longer able to litigate this action and would only be seeking filing fees.”  “Since then, the Court ordered the parties to file a joint status report, and Plaintiff failed to respond to the FBI’s attempts to elicit his agreement or objections to its proposed joint status update, which the FBI says it twice mailed to Plaintiff without response.”  “Plaintiff’s failure to participate in this action, including by failing to comply with Court orders, prevents this action from proceeding, and neither the public’s interest in expeditious resolution of litigation nor the Court’s need to manage its docket are served by allowing this now eight-year-old action to continue.”  “The Court will therefore dismiss Plaintiff’s remaining FOIA claims in Counts III and IV and this action without prejudice for failure to prosecute pursuant to [Federal Rules of Civil Procedure 41(b)].”
