Date

Van Kush v. 10th Cir. Exec./Admin. Off. of the Judges, No. 20-02862, 2020 WL 6075683 (D.D.C. Oct. 15, 2020) (Friedrich, J.)

Re:  "[P]etitioner['s] demand[] that the court issue a writ of mandamus compelling the Drug Enforcement Administration . . . to process and produce certain records that he apparently requested pursuant to the [FOIA]"

Disposition:  Dismissing mandamus petition without prejudice

  • Litigation Considerations:  The court holds that "[t]o the extent that the petition can be construed as seeking a writ of mandamus against the DEA, it is denied."  The court explains that "Petitioner does not address any of [the elements needed for mandamus], and petitioner does, in fact, have alternative and adequate remedies to mandamus, namely, by filing suit pursuant to FOIA . . . ."
