Ann Scarborough was sentenced on September 30, 2011 to imprisonment for 72 months with three years supervised release before Judge William J. Haynes, Jr. The defendant was also ordered to pay special assessment in the amount of $800 and restitution in the amount of $2,661,811.00.

Kenneth Kennedy  was sentenced on June 24, 2011 to imprisonment for 100 months with three years supervised release before Judge William J. Haynes, Jr. The defendant was also ordered to pay special assessment in the amount of $800 and restitution in the amount of $3,024,291.70 .

Sheila Kennedy  was sentenced on November 12, 2010 to imprisonment for 136 months with three years supervised release before Judge William J. Haynes, Jr.. The defendant was also ordered to pay special assessment in the amount of $400 and restitution in the amount of $2,621,799

On February 19, 2010, U.S. District Judge William Haynes held a status conference.  At the conference, the Court continued the current March 23, 2010 trial date.  Although the new trial date has not been set, the Court has scheduled another status conference for March 12, 2010 at 3:30 PM.  At that conference, among other things, Judge Haynes is expected to set a new date for the trial.  When the Court does set a trial date, victims will receive notice via the Victim Notification System (VNS), and this website will be updated to reflect the new date.  As always, because court dates often change without advance notice, persons interested in attending any hearings are encouraged to contact the U.S. Attorney’s Office victim-witness coordinator before traveling to the courthouse to confirm the date, time, and nature of the hearing.

The sentencing hearing of Sheila Kennedy set for November 6, 2009 has been continued pending further Order of the Court.

On March 24, 2009, Sheila Kennedy pleaded guilty to one count of wire fraud, one count of mail fraud, and two counts of money laundering.  Recently, this case was reassigned from U.S. District Judge Robert Echols to U.S. District Judge William Haynes, which has caused scheduling changes.   The sentencing hearing for Sheila Kennedy has been reset to 10:00 am, November 6, 2009.  The trial of the remaining defendants, Kenneth Kennedy, Ann Scarborough, and Philip Russell, which was scheduled for December 8, 2009, has not yet been rescheduled.  We expect Judge Haynes will issue a scheduling order shortly, and the new trial date will be posted as soon as it is known.
