Mexican National Previously Convicted of Sexually Assaulting a Minor Arrested in El Paso
EL PASO, Texas – A Mexican national with a violent criminal record was arrested in El Paso on criminal charges related to his alleged illegal re-entry.
According to court documents, Jose Juan Garcia Tiro was determined upon arrest to be in the United States illegally. He had been previously removed from the country to Mexico on April 23, 2015. In 2007, Garcia Tiro was convicted in Ocean, New Jersey and sentenced to eight years in prison for sexually assaulting a prepubescent minor.
Garcia Tiro is charged with one count of illegal re-entry. He was ordered in a Feb. 10 hearing to be detained without bond. If convicted, he faces up to 10 years in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
U.S. Attorney Jaime Esparza for the Western District of Texas made the announcement.
The U.S. Border Patrol is investigating the case.
Assistant U.S. Attorney Patricia Aguayo is prosecuting the case.
A criminal complaint is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
