411. Substance of Customer Notice

The purpose of the investigation as stated in the customer notice need not include reference to specific sections of Title 18 believed to have been violated but should include the generic classification of the offenses (i.e., fraud, bribery of a federal official, extortion, narcotic trafficking, theft of federal property). The customer notice must also state the name and business address of the government official to be served with copies of the customer challenge papers; this generally should be the officer who initiates the legal process seeking access.

The provisions of the Act pertinent to customer notice can be found in the sections relating to the various forms of proceyss; 12 U.S.C. § 3405 for administrative process; 12 U.S.C. § 3407 for judicial subpoenas; and 12 U.S.C. § 3408 for formal written requests.

Suggested forms are: Form DOJ-464 for customer notice; Form DOJ-465 for a motion to enjoin or quash; and Form DOJ-466 for a sworn statement.
