Court Assigned: This case is assigned to United States District Judge Kent J. Dawson, United States District Court for the District of Nevada, LV Courtroom 4A, 333 Las Vegas Blvd South, Las Vegas, NV 89101. Unless noted in an update below, all court events will take place at this location.
UPDATE – January 30, 2019: Following an extradition process from Canada, defendant Sean P. Finn had his initial appearance and arraignment on August 2, 2018. That same day, the court ordered Finn detained pending trial.
The court scheduled a pretrial status hearing for defendant Finn for July 9, 2019, at 9:00 AM.
In addition, a trial for defendant Finn has been set for July 15, 2019, at 9:00 AM.
The restitution and forfeiture hearing previously scheduled for defendants Anthony Brandel and James Warras on January 16, 2018 at 09:00 AM has been continued to a later date not yet scheduled.
The restitution and forfeiture hearing previously scheduled for defendants Anthony Brandel and James Warras on August 29, 2017, at 09:00 AM has been rescheduled to December 5, 2017, at 09:00 AM.
The restitution and forfeiture hearing previously scheduled for Anthony Brandel and James Warras on June 14, 2017, at 9:00 AM has been rescheduled for August 29, 2017, at 9:00 AM.
The restitution and forfeiture hearing previously scheduled for Anthony Brandel and James Warras on May 3, 2017, at 9:00 AM has been rescheduled for June 14, 2017, at 9:00 AM.
The restitution and forfeiture hearing previously scheduled for Anthony Brandel and James Warras on March 3, 2017, at 9:00 AM has been rescheduled for May 3, 2017, at 9:00 AM.
On February 22, 2017, the court rescheduled the restitution and forfeiture hearing for Anthony Brandel and James Warras from February 22, 2017 at 9:00 AM for March 3, 2017 at 9:00 AM.
On August 3, 2016, Anthony Brandel and James Warras were each sentenced to 87 months of incarceration, followed by 3 years of supervised release. A restitution and forfeiture hearing is scheduled for February 22, 2017 at 9:00 AM.
On March 3, 2016, Joseph Micelli was sentenced to 5 years of incarceration followed by 3 years of supervised release. Micelli was also ordered to pay restitution in the amount of $5,650,000.00. It is important for you to know that just because the Court ordered the defendant to make restitution in this case, it does not mean that the defendant is financially capable of making restitution at this time. In the event that sufficient restitution payments are received from the defendant, the funds will be distributed by the Clerk of the United States District Court for the District of Nevada.
On December 7, 2015, Anthony Brandel, was found guilty of one count of conspiracy to commit wire fraud and securities fraud, nine counts of wire fraud, and eight counts of securities fraud in a jury trial. James Warras, was also found guilty of one count of conspiracy to commit wire fraud and securities fraud, six counts of wire fraud, and six counts of securities fraud.
On November 24, 2015, Joseph Micelli pleaded guilty to one count of conspiracy to commit wire fraud and securities fraud. Any remaining counts will be disposed of at the time of sentencing. As a result of the guilty plea, there will be no trial involving this defendant. The sentencing hearing for Micelli, has been set for February 23, 2016, 9:00 a.m.
