Court Assigned: This case is assigned to Chief Judge K. Michael Moore, U.S. District Court for the Southern District of Florida, Wilkie D. Ferguson, Jr., U.S. Courthouse, 400 North Miami Ave., FL 33128. Unless noted in an update below, all court events will take place at this location.


UPDATE – On January 14, 2019, the court reduced defendant Lerner’s sentence from 60 months to 30 months with all other terms and conditions remaining the same.


May 8, 2018: On April 4, 2018, the court ordered defendant Lerner to pay restitution in the amount of $21,234,214.

It is important for you to know that just because the court ordered the defendant to make restitution in this case does not mean that the defendant is financially capable of making restitution at this time.


On January 11, 2018, defendant Lerner was sentenced to 60 months of incarceration, followed by 3 years of supervised release. A restitution hearing is scheduled for April, 3, 2018, at 11:00 AM.

The defendant was remanded to the custody of the U.S. Marshall.


On October 12, 2017, Lerner pleaded guilty to a single count superseding information charging conspiracy to commit securities fraud, lying to the auditors of a publicly traded company, and falsifying the company’s books and records. Lerner is scheduled to appear for sentencing on January 11, 2018, at 2:00 PM.

A telephonic status conference for Hyunjin Lerner is set for May 4, 2017 at 3:00 PM before Magistrate Judge Andrea M. Simonton. The court also scheduled a status hearing for September 28, 2017 at 2:00 PM.

A trial date is scheduled for October 2, 2017.
