Defendants David Bermingham, Gary Mulgrew, and Giles Darby, former employees of Greenwich NatWest (NatWest), a structured-finance division of the former National Westminster Bank Plc, pleaded guilty on November 28, 2007 before Judge Ewing Werlein, Jr. in U.S. District Court in Houston, Texas. All three defendants pleaded guilty to a single count of wire fraud in connection with a secret investment with former executives of the Enron Corporation.
Each of the three defendants was sentenced on February 22, 2008 to 37 months' incarceration and ordered to pay approximately $7.3 million in restitution to the Royal Bank of Scotland, the successor bank to Nat West, of which $1.25 million must be paid when they surrender to the Bureau of Prisons.
Defendant David Bermingham has been ordered to surrender by 2:00 p.m. on May 9, 2008, at FCI LOMPOC, 3600 Guard Road, Lompoc, CA 93436.
Gary Mulgrew has been ordered to surrender by 2:00 p.m. on April 30, 2008 to the FCI Big Spring, 1900 Simler Avenue, Big Spring, Texas 79720. And, defendant Giles Darby will be surrendering by 2:00 p.m. on May 7, 2008 to the FCI Allenwood LOW, White Deer, PA 17810.
