Derrick Strong v. City of Chicago Fire Department (N.D. Ill.)

Overview

On December 17, 2019, the United States filed a complaint on behalf of US Army Reservist Derrick Strong in Strong v. City of Chicago (N.D. Ill.).  The complaint alleged that the City denied Strong the opportunity to take a Fire Engineer promotional examination (missed due to an active-duty deployment) upon his return from military service in violation of the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).  On September 1, 2023, the settlement agreement was fully executed, and the Parties filed a stipulation for dismissal. As part of the settlement agreement, the City administered a promotional examination to Strong and promoted him to the rank of Fire Engineer with a retroactive seniority date. The agreement also required the City to pay Strong $52,000.
