John A. Eisenberg

John A. Eisenberg, Assistant Attorney General for National Security, was confirmed by the United States Senate and sworn into office on June 5, 2025. In his role, AAG Eisenberg leads the National Security Division’s prosecuting sections: the Counterintelligence and Export Control Section (CES); the Counterterrorism Section (CTS); and the National Security Cyber Section (NatSec Cyber). AAG Eisenberg also leads the Division’s non-prosecuting sections: the Foreign Investment Review Section (FIRS), which handles matters before the Committee on Foreign Investment in the United States and “Team Telecom”; the Division’s Law & Policy Section (L&P), which provides legal advice and assistance on matters of national security law and handles or coordinates national security legislative, policy, and appellate matters; and the Office of Justice for Victims of Overseas Terrorism (OVT), which supports U.S. victims of international terrorist attacks. Additionally, AAG Eisenberg serves as the primary liaison between the Department of Justice and the Intelligence Community and oversees the administration of the Foreign Intelligence Surveillance Act (FISA) through the Division’s Office of Intelligence (OI), including oversight of agency implementation of FISA and litigation before the Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review.

AAG Eisenberg has deep experience in both government and private practice as a national security attorney. During President Trump’s first term, AAG Eisenberg served as the Legal Advisor to the National Security Council, Assistant to the President, and Deputy Counsel to the President. In those roles, he regularly advised the President on the legal dimensions of the most significant national security issues facing the country. Earlier in his career, AAG Eisenberg served in several senior positions at the Department of Justice, including Associate Deputy Attorney General and Deputy Assistant Attorney General in the Office of Legal Counsel. In private practice, AAG Eisenberg was a partner at Kirkland & Ellis LLP.

AAG Eisenberg graduated from Yale Law School, where he was an articles editor of the Yale Law Journal, and Stanford University. He clerked for Justice Clarence Thomas of the Supreme Court of the United States and Judge J. Michael Luttig of the United States Court of Appeals for the Fourth Circuit.
