7/25/2016 - The Honorable Paul D. Borman scheduled a motion hearing for Friday, August 19, 2016 at 11:00 a.m.   The purpose of this hearing is to address the Petition regarding restitution, filed on behalf of individuals with civil lawsuits in Oakland County Circuit Court, and the Government's Motion to Dismiss the Petition.  The hearing will take place in Judge Borman's courtroom on the 7th floor of the United States District Court (Courtroom 737) located at 231 W. Lafayette, Detroit, MI 48226

6/8/2016 - Beginning on June 9, the Claim Form for the restitution process in the criminal case of United States v. Farid Fata will be available on www.fataclaims.com

Claim Forms will be mailed to individuals who received a "Victim Notification Letter" from the U.S. Attorney's Office.  You may use either the version mailed to you or the version available on www.fataclaims.com as the Claim Form is exactly the same.

For those who did not receive a "Victim Notification Letter" and do not have access either to a computer and/or to a printer, please contact 1-877-202-3282 (on or after June 9) and request that a Claim Form be mailed to you.

The Claim Form will be accompanied by a letter from the United States v. Fata Facilitator, Randi Ilyse Roth, and detailed instructions.  Please review the instructions carefully. 

There are important dates in the letter from Ms. Roth, in the instructions, and in the Claim Form.  Please review the letter, the instructions, and the Claim Form as soon as possible, because there will be no deadline extensions allowed.

To assist you in answering questions you may have about submitting a claim for restitution, the following resources will be available:

  1. Beginning on June 9, trained phone staff will be on duty every weekday from 9:00 a.m. to 8:00 p.m. (Eastern Time) at this toll-free number: 1-877-202-3282.  Please feel free to call them.
  2. Also beginning on June 9, you may check the website, www.fataclaims.com, for information and updates about the claims process.  You will find a Frequently Asked Questions (FAQ) page on www.fataclaims.com which will be updated when common questions arise during the process.

5/31/2016 - The claim form and instructions for the restitution process are currently scheduled to be posted on this webpage and on fataclaims.com during the week of June 6.  Patients and/or family members who received a "Victim Notification Letter" from the U.S. Attorney's Office will be mailed a claim form the same day that the claim form is available on the two websites.  If you have any questions, please do not hesitate to contact Sandy Palazzolo, Victim Witness Coordinator, at 313-226-9633.


5/25/2016 – The U.S. Court of Appeals for the Sixth Circuit has affirmed Farid Fata’s convictions and sentence.  Therefore, the sentence originally imposed by Judge Borman will remain as Fata’s sentence.

4/25/2016 – The U.S. Court of Appeals for the Sixth Circuit will hear the oral arguments in this case on April 28, 2016 in Courtroom number 842.  Please be advised that these proceedings will take place at the U.S. Court of Appeals for the Sixth Circuit, Potter Stewart U.S. Courthouse, 100 East Fifth Street, Cincinnati, Ohio 45202.  There is no specific time scheduled for the oral argument to begin in the U.S. v. Fata case.  Court will begin at 9:00 a.m.  with the oral argument for U.S. v. Farid Fata as second on the Court’s schedule.  The audio recording of the oral argument will be available the latter part of the afternoon on April 28, 2016, on the Court of Appeals for the Sixth Circuit’s website at http://www.ca6.uscourts.gov/internet/court_audio/aud1.php.

3/10/2016 -  Judge Paul D. Borman scheduled a Status Conference for Monday, March 28, 2016 at 3:00 p.m.  The purpose of this conference is to address the restitution procedures.


3/10/2016 – The United States Court of Appeals for the Sixth Circuit has scheduled an oral argument regarding the appeal filed by Farid Fata.   The argument will be Thursday, April 28, 2016 at 9:00 a.m.  Please note that the oral  arguments by the attorneys will not be in Detroit.  They will take place at the federal courthouse in Cincinnati, Ohio, which is located at 100 East Fifth Street.  A courtroom has not yet been assigned.  Further information and/or updates will be posted on this webpage prior to April 28.


2/22/2016 - Judge Paul D. Borman scheduled a Status Conference for Thursday, March 10, at 2:00 p.m.  The purpose of this conference is to address the status of the development of the restitution procedures.

1/29/2016 - Restitution Process Update: The restitution process involving assets seized from Farid Fata is ongoing. The government is in the process of liquidating Fata’s assets, a necessary step before any funds can be made available. The government’s goals are to maximize the amount of money available and to create a fair and equitable process by which patients and family members of former patients can apply for available funds.  Please be aware that no restitution application form has been distributed by the federal government.  If you have seen a restitution form, it is not the form that will be used in this federal case.  When the process is finalized and the restitution application is available, it will be by court order from Judge Borman and further information will be posted on this web page, including the process by which applications can be completed and submitted for review.

11/13/2015 - The Department of Justice is continuing to finalize details and arrangements for the restitution process and the restitution facilitator.

7/29/2015-   The Court will begin the process of discussing and determining the restitution procedures at a conference scheduled for Thursday, July 30 at 11:30 a.m.  Patients seeking restitution need not be present at the conference on July 30 to request restitution pursuant to the procedures and guidelines determined and approved by the Court.  All updates and procedures regarding the restitution process will be posted on this webpage.


7/10/2015 – Judge Borman sentenced defendant Farid Fata to a term of 45 years in prison.

7/9/2015 – Judge Paul D. Borman scheduled the sentencing of defendant Farid Fata for Friday, July 10, 2015 at 10:00 a.m. There will be seats and live video of the proceedings in overflow rooms at the Courthouse for those who wish to view the sentencing.


7/1/2015 - The Court sets a new starting time for the sentencing proceedings on Monday morning, July 6. The proceedings will begin at 8:30 a.m. on Monday, July 6.


7/1/2015 - The Court has established the following rule for decorum inside the United States District Courthouse: The Court respectfully requests that individuals do not wear items (pins, t-shirts, etc.) or openly carry items (photos, banners, signs, etc.) depicting images of former patients or containing comments regarding the case or the defendant while inside the United States District Courthouse. You may have them with you for support during this process; however, they may not be visible while inside the courthouse.

Sentencing proceedings will begin on Monday, July 6, 2015, at 9:00 a.m.  The proceedings will continue every business day thereafter between the hours of 9:00 a.m. and 1:30 p.m. until the imposition of the sentence. The exact date and time of the imposition of the sentence is unknown at this time.

After requesting seats from Ms. Palazzolo, the available seats in Courtroom 737 for each day of the proceedings will be determined by a lottery system prior to July 6, because the courtroom is not large enough to accommodate all those who wish to attend.  Former patients and their family members will be notified prior to July 6 if they have been randomly selected to sit in Courtroom 737 and on which date(s) they have been randomly selected to sit in Courtroom 737.  If you are randomly selected to sit in Courtroom 737, one seat will be reserved for you and one seat will be reserved for one guest to accompany you. Seating will be located in designated benches behind the government’s table.

Additional seats will be available in Room 115 and Courtroom 712 of the Courthouse each day.  A live audio and video feed of all proceedings will be provided in Room 115 and Courtroom 712.   The seats provided in Room 115 and Courtroom 712 are available for those who wish to view the proceedings but are not randomly selected to sit in Courtroom 737 and for those patients and family members who do not wish to request Courtroom 737 seating.  Seating in Room 115 and Courtroom 712 will be on a first come, first served basis.  The general public and the media will also have access to Room 115 and Courtroom 712 seating.   Interviews by the media will not be permitted in any location inside the Courthouse or any area which prevents ingress to and egress from the Courthouse.  Court Security will be present in Room 115 and Courtroom 712 to maintain the same decorum as set forth for Courtroom 737.

Courtroom Decorum

Courtroom 737 will be open fifteen (15) minutes before each court session.  To minimize disruptions in the Courtroom, all media personnel and spectators with reserved seats should be seated five (5) minutes before each session and should remain seated throughout the proceedings until a court recess.  Only counsel and an assistant will be permitted to enter and exit the Courtroom once proceedings have commenced.

No disruptive conversations or gestures are permitted in the Courtroom. Failure to comply with these rules will result in removal from the Courtroom.

No one viewing these proceedings in this Courthouse may bring into the Courthouse any cameras, electronic recording, or communication devices of any kind.

To assist with overall security and general public access to the Courthouse, the Court has designated the usual outside area for media use throughout the sentencing proceedings: the north side of Lafayette, across from the Courthouse.  This is the only area where interviews, still pictures, and film coverage can be activated and conducted.

No member of the media shall attempt to secure an interview or conduct an interview in the Courthouse or in any area which prevents ingress to and egress from the Courthouse.

Public gatherings are allowed on the public sidewalks surrounding the Courthouse. At no time should public access to the Courthouse be restricted by media covering events.

In Addition to the Information Provided in the Order, Please Note the Following Additional Important Information Regarding Attendance at the Sentencing Proceedings:

Parking:

Parking is available in various lots and structures surrounding the courthouse.  Cost for parking ranges from $8.00/day to $20.00/day.

Handicap entry to the Courthouse is available at the Fort Street entrance.  Parking is not provided by the Courthouse or by the United States Attorney’s Office.  Therefore, handicap parking cannot be arranged.  Individuals requiring assistance should be accompanied by someone.

Security:

Security screening will be required to gain entry into the Courthouse.  If you are selected for seating in Courtroom 737 seating, there will be a required second security screening in order to enter the courtroom.

Photo identification is required.

Phones, recording devices, cameras, laptops, and/or other electronic devices are not permitted in the Courthouse.  There are no lockers or safe areas in which to leave these items.  If you forget and have one of these items in your possession, you will be required to return it to your vehicle.

Knives, weapons, scissors, or any other sharp object which could be used as a weapon are prohibited.

Proper credentials/identification are required for service animals.

Please arrive early to allow sufficient time to pass through security.

There is a coffee/snack shop on the premises. However, food and beverages are NOT permitted in Courtroom 737, in Room 115, or in Courtroom 712.

4/23/2015 - Judge Paul D. Borman scheduled a new Sentencing Hearing date.   The hearing is now scheduled to begin on Monday, July 6, 2015 at 9:00 a.m. and will conclude no later than July 20, 2015. Please be advised that the date and time Judge Borman will  impose sentence is not known at this time.  The imposition of sentence date and time will be determined during the sentencing proceedings.

4/20/2015 – The Court adjourned the sentencing of defendant Fata.   The Court  indicated it requires additional time to review all of the Victim Impact Statements prior to sentencing.  A new date has not yet been scheduled. 1/30/2015 - Judge Paul D. 9/16/2014 HEARING ADJOURNED Dr. Farid Fata entered a plea of guilty to the following charges:   Thirteen counts of Health Care Fraud;  One count of Conspiracy to Pay and Receive Kickbacks; Two counts of Money Laundering.  Sentencing is currently scheduled to begin on February 23, 2015  at 10:00 a.m.

9/09/2014 - Judge Paul D. Borman scheduled a hearing to address the defendant’s “Motion to Suppress Evidence.”   The hearing will take place on Tuesday, September 16, 2014 at 3:00 p.m., in courtroom 737.


9/8/2014 – Tuesday, September 16, 2014, 3:00 p.m. Final Pretrial Conference/Final Plea Date. During this Court hearing, various trial issues may be discussed. It is also the last date and time that the defendant can plead guilty in Court under a plea agreement.


6/16/2014 - The Honorable Paul D. Borman issues a Third Amended Scheduling Order   
A final pretrial conference is scheduled for September 16, 2014 at 3:00 p.m.  
The Court changes the trial date from October 21, 2014 to October 14, 2014      
Jury selection will begin on October 14, 2014at 9:30 a.m.
Starting on October 15, 2014, the hours of jury selection will be 9:00 a.m. to 4:00 p.m. until a jury is selected. 
Once a jury is selected, trial will begin.  Trial hours will be 9:00 a.m.to 1:00 p.m   
Near the conclusion of the trial and during closing arguments and deliberations, the trial hours will change to 9:00 a.m. to 4:00 p.m.  
All above referenced court proceedings will take place in the courtroom of the Honorable Paul D. Borman, courtroom 737.


6/11/2014 - The Honorable Paul D. Borman issues an order adjourning the trial date.  Trial is now scheduled to begin on October 21, 2014 at 9:00 a.m. in courtroom 737.

6/10/2014 - Defense counsel files a Notice of Withdrawal of Motion for Appointment of Counsel.  As a result, the hearing currently scheduled for June 12, 2014, will be cancelled.

6/3/2014 -  The defense requested additional time to prepare for trial.  Following this request, the Court moved the trial date to October 14, 2014, 9:00 a.m. in the courtroom of the Honorable Paul D. Borman, courtroom 737.


6/3/2014 -  CANCELLED Judge Paul D. Borman has scheduled a motion hearing to address the defendant’s “Motion to Appoint Counsel.”  The hearing will take place on June 12, 2014 at 1:00 p.m., in courtroom 737.

5/12/2014 - Judge Paul D. Borman has scheduled a motion hearing to address the defendant’s “Motion for Change of Venue.”   The hearing will take place on June 3, 2014 at 2:00 p.m., in courtroom 737.

3/3/2014 - Judge Paul D. Borman has scheduled a subpoena procedure hearing to take place on March 10, 2014 at 2:00 p.m.


2/4/2014 – Dr. Farid Fata is arraigned on the fourth superseding indictment.  Judge Borman confirmed the trial will begin on August 12, 2014, and will be in session Monday through Friday  from 9:00 a.m. – 1:00 p.m.  Any updates or newly scheduled court events will be reflected on this web site and the victim information line.


1-23-14 – The United States Court of Appeals for the Sixth Circuit enters an order affirming Judge Borman's order detaining Dr. Farid Fata pending trial.

1/15/2014 - A 4th Superseding Indictment is filed against Dr. Farid Fata. This new indictment supersedes the 1st, 2nd and 3rd  Superseding Indictments. The 4th Superseding Indictment now charges Dr. Fata with the following federal criminal violations:

Counts 1 through 19 - Health Care Fraud

Count 20 - Conspiracy to Pay and Receive Kickbacks

Count 21 - Unlawful Procurement of Naturalization

Counts 22 and 23 - Money Laundering

An arraignment and status conference are currently scheduled for February 4, 2014 at 10:00 a.m., before the Honorable Paul D. Borman.

1-10-14 – Judge Paul D. Borman scheduled a status conference to take place on January 15, 2014 at 9:00 a.m.


12/18/2013 - A 3rd Superseding Indictment is filed against Dr. Fata. This new indictment supersedes the 1st and 2nd Superseding Indictments. The 3rd Superseding Indictment now charges Dr. Fata with the following federal criminal violations:

Counts 1 through 19 - Health Care Fraud

Count 20 - Conspiracy to Pay and Receive Kickbacks

Count 21 - Unlawful Procurement of Naturalization

An arraignment is currently scheduled for February 4, 2014 at 10:00 a.m., before the Honorable Paul D. Borman. This hearing will take place in conjunction with the status conference currently scheduled for the same date and time in Judge Borman’s courtroom, room 737.

12-16-13 – Judge Paul D. Borman grants defense counsel’s request to adjourn the trial date. A new trial date has been scheduled for April 8, 2014, 9:00 a.m. A status conference has been scheduled to take place on February 4, 2014 at 10:00 a.m.


12/2/2013 – Dr. Farid Fata is arraigned on the second superseding indictment. Another status conference has been scheduled for Monday, December 16, 2013 at 11:00 a.m. The date of the conference may change to Thursday, December 12 or Friday, December 13. Any changes will be reflected on this website and on the information line.


11/27/13 - Arraignment on the Second Superseding Indictment and Status Conference are scheduled to take place on 12/2/13 at 3:00 pm in the courtroom of the Honorable Paul D. Borman


11/20/2013 - The U.S. Attorney’s Office files a 2nd Superseding Indictment adding additional counts.  This new indictment supersedes the 1st Superseding Indictment.  The new indictment now charges Dr. Fata with the following federal criminal violations:
Counts 1 through 17 - Health Care Fraud
Count 18 - Conspiracy to Pay and Receive Kickbacks
Count 19 - Unlawful Procurement of Naturalization

10/2/2013   Judge Borman holds a hearing to address the defendant’s motion requesting a modification of bond conditions.  An order of detention pending trial is entered by the judge for defendant Dr. Farid Fata.   Dr. Fata will remain in custody during the pendency of this case.  Judge Borman’s ruling does not signify a determination of guilt, only a determination that there is a risk of flight based on the evidence presented.


9/24/2013 -  Judge Borman schedules the date and time of the arraignment on the superseding indictment.   The arraignment will take place on October 2, 2013 at 9:30 a.m., in conjunction with the motion hearing outlined below in line item 9/20/13.    The purpose of the arraignment is to formally provide Dr. Fata with a copy of the superseding indictment outlining the new charges he is facing.  Both hearings will take place in the Courtroom of the Honorable Paul D. Borman, room 737.

9/20/2013 -  Judge Borman reschedules the time currently scheduled for the motion hearing.   Please note this hearing will now take place on  October 2, 2013 at 9:30 a.m.  The motion hearing will address the defendants request for a modification of the bond/pretrial release conditions.  This hearing will take place Courtroom of the Honorable Paul D. Borman, room 737.


9/17/2013 – The U.S. Attorney’s Office supersedes the original grand jury indictment, adding additional counts. The new indictment now charges Dr. Fata with the following federal criminal violations:

Counts 1 through 12 - Health Care Fraud
Count 13 - Conspiracy to Pay and Receive Kickbacks
Count 14 - Unlawful Procurement of Naturalization

9/11/2013 – The Honorable Paul D. Borman schedules a motion hearing to take place on October 2, 2013 at 10:30 a.m. to address the defendant’s motion for modification of pretrial release/bond conditions.  Hearing will take place in Judge Borman’s  courtroom number 737, located on the 7th floor of the United States District Court.

8/21/2013 – The Honorable Paul D. Borman schedules a trial date of October 15, 2013 at 9:00 a.m.  Trial will take place in Judge Borman’s  courtroom number 737, located on the 7th floor of the United States District Court.

8/14/2013 – The U.S. Attorney’s Office obtains a grand jury indictment, charging Dr. Fata with one count of “Health Card Fraud”.

8/13/2013 – The Honorable Sean F. Cox sets bond/pretrial release for defendant Dr. Fata in the amount of $9,000,000 secured.   Unable to post bond, defendant remains in custody.

8/8/2013: Magistrate Judge David R. Grand signs a bond order for the defendant.  The government appeals Magistrate Judge Grand’s order.

8/6/2013:  Federal search warrants are executed at the offices of Dr. Farid Fata.  Dr. Fata is arrested and charged in a federal criminal complaint with Health Care Fraud.  The government requests that the court detain the defendant in the custody of the U.S. Marshal Service pending the resolution of the case.
