About the Office: 

The Environment and Natural Resources Division (ENRD) of the U.S. Department of Justice is seeking an experienced litigator for its Appellate Section for a full-time position in Washington, DC.

The Appellate Section is responsible for handling cases in federal and state courts of appeals involving the ENRD, for preparing appeal recommendations, and for preparing drafts for the Office of the Solicitor General of petitions, responses, and briefs in most ENRD cases before the U.S. Supreme Court.

Job Description: 

This advertisement is for a staff level attorney position.  The individual selected will be responsible for handling appellate litigation in a wide range of matters such as air, water, and solid waste regulation; hazardous substance clean-ups; public land and forest management; water rights; Indian treaty rights and Indian gaming; land condemnation; Fifth Amendment takings; fish and wildlife conservation; and criminal environmental prosecutions.

Qualifications: 

Applicants must possess a J.D. degree, be an active member of the bar (any jurisdiction) and be a U.S. citizen or national.  Applicants with Court of Appeals experience or with a background in environmental or natural resources law will be preferred.

Specific grade level requirements:

  • At least 3 years of post-JD litigation and/or judicial experience to qualify at the GS-13 grade level.
  • At least 4 years of post-JD litigation and/or judicial experience to qualify at the GS-14 grade level.
  • At least 5 years of post-JD litigation and/or judicial experience to qualify at the GS-15 grade level.
     

You must complete a background investigation and pre-employment drug testing.

Salary: 
Current salary and years of experience will determine the appropriate salary level. The possible salary range is: GS-13 ($96,970 - $126,062); GS-14 ($114,590 - $148,967), GS-15 ($134,789 - $164,200) per annum.
Travel: 
Occasional travel is required.

Suitability and Citizenship:  It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment.  Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see, https://www.usajobs.gov/Help/working-in-government/non-citizens/). Veterans:  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions.
