134. Third factor—the extent and nature of the juvenile's prior delinquency records and social background of the juvenile

This is a factor which should best be presented through testimony of the juvenile probation officer(s). Juvenile probation records should reflect the juvenile's past arrests and the manner in which the juvenile was handled by authorities, including any delinquency determinations and detention of the juvenile. Some juvenile officials may require a subpoena or court order prior to divulging the juvenile's records. A lack of prior record of delinquency acts would weigh against transfer. See M.L., 811 F. Supp. at 495. A record showing criminal episodes becoming more serious and frequent over time can weigh in favor of transfer. M.H., 901 F. Supp. at 1215.
