Appeals Division

Overview

The Appeals Division, consisting of a Chief, a Civil Appeals Coordinator, two appellate attorneys, and two administrative assistants, conducts and oversees all criminal and civil appellate litigation for the United States Attorney’s Office for the Northern District of New York (“NDNY”).  Appeals Division prosecutors draft appellate briefs, which are filed in the Court of Appeals for the Second Circuit, and assist other Assistant United States Attorneys in drafting briefs.  The Appeals Division prosecutors also present and assist others in presenting oral arguments in the Second Circuit.  In most instances, the Appeals Division’s briefs and oral arguments defend convictions, sentences, and various decisions by NDNY district courts, but occasionally the Appeals Division seeks appellate court review of decisions that are adverse to the federal government.  The Appeals Division works closely with the Appellate Section of the Criminal Division of the United States Department of Justice and the Office of the Solicitor General.  It also provides legal advice and training to NDNY Assistant United States Attorneys, including the management team of the United States Attorney’s Office.
