Schenectady Man Charged With Receipt And Possession Of Child Pornography

Defendant Alleged to Have Received and Possessed
Approximately 600 Child Pornography Files

ALBANY, NEW YORK – A two-count criminal complaint has been filed in the Northern District of New York charging HARRY GATES, age 47, of Schenectady, New York, with receipt and possession of child pornography, announced United States Attorney Richard S. Hartunian and Nicholas DiNicola, Assistant Special Agent-in-Charge, U.S. Immigration and Customs Enforcement, Homeland Security Investigations.1 If convicted, GATES faces at least five years of imprisonment and up to twenty years of imprisonment on the receipt of child pornography charge and up to ten years of imprisonment on the possession of child pornography charge as well as a maximum fine of $250,000. GATES is held without bond pending his preliminary hearing which has been scheduled for December 10, 2013 at 1:30 p.m. before the Honorable Christian F. Hummel, United States Magistrate Judge.

According to the complaint, between February 2012 and November 22, 2013, GATES searched for and downloaded several hundred still image and video files of child pornography onto his home computer using the Internet and file sharing programs.

This case is being investigated by Homeland Security Investigations. This case is being prosecuted by Assistant United States Attorney Rick Belliss.
