On July 16, 2024, defendant Andrew Badolato filed a motion seeking a reduction in his sentence from 36 months’ imprisonment to 33 months’ imprisonment.
Under the Crime Victims’ Rights Act, victims have “[t]he right to be reasonably heard at any public proceeding in the district court involving release, plea, sentencing, or any parole proceeding.” 18 U.S.C. § 3771(a)(4).

Consistent with the Crime Victims’ Right Act, 18 U.S.C. § 3771, victims have the right to be reasonably heard at the sentencing proceeding, including by letter, statement, or other submission to the court, and to confer with counsel for the Government in the case, and to full and timely restitution.

On April 21, 2022 defendants Andrew Badolato and Brian Kolfage appeared before the Court for a change of plea proceeding and pleaded guilty to Count One of Indictment No. 20 Cr. 412. Brian Kolfage also pleaded guilty to Counts One, Two, and Three of Indictment 22 Cr. 201. Both defendants are scheduled for sentencing on December 14, 2022, at 3 p.m., in courtroom 15D of the Daniel Patrick Moynihan United States Courthouse, 500 Pearl Street, New York, NY 10007, before the Honorable Analisa Torres.

On August 20, 2020, the United States Attorney’s Office announced the unsealing of federal felony charges against BRIAN KOLFAGE, STEPHEN BANNON, ANDREW BADOLATO, and TIMOTHY SHEA, in connection with an alleged conspiracy to defraud donors to a crowdfunding campaign called “We Build the Wall.” The indictment alleges the defendants conspired to commit wire fraud and to commit money laundering.
