Procedures for Completing Uniform Periodic Reports in Non-Small Business Cases Filed Under Chapter 11 of Title 11; Proposed Periodic Reports and Instructions
On February 17, 2016, the United States Trustee Program held a public hearing, and interested parties expressed their views on the proposed rule and forms to a panel of Program officials. The transcript of the public hearing is available here. The United States Trustee Program published a notice of the public hearing on November 30, 2015, and also reopened the comment period in order to accept new or supplemental comments. The reopened comment period closed on February 22, 2016.
The proposed rule sets forth procedures and criteria that non-small debtors in possession and trustees shall use when accounting for the receipt, administration, and disposition of property, and providing information about the estate and its business, including statements of receipts and disbursements, as required by 11 U.S.C. §§ 1106(a)(1) and 1107(a). The proposed rule was published in the Federal Register. The proposed Periodic Report forms and instructions are not published in the Federal Register, but are available for review at the links below.
The notice of the public hearing, the transcript, the proposed rule, comments submitted during the reopened comment period, and the proposed forms and instructions are available at www.regulations.gov. The proposed rule and comments submitted by the initial comment deadline of January 9, 2015, are also available at www.regulations.gov.
The United States Trustee Program is considering all views expressed at the public hearing, the public comments, and other information and will issue a Final Rule when that process is completed.
Note: Debtors in possession and trustees will be required to use the reports in all chapter 11 cases that are not small business cases. However, until this proposed rule becomes final and effective, all non-small business debtors should continue to use the periodic reporting forms currently in use in their respective jurisdictions.
