2459. 49 U.S.C. 80501 [formerly 15 U.S.C. 1281 And 1282 Transferred Effective July 5, 1994] Damage To Property Being Transported In Interstate Or Foreign Commerce

This statute specifically forbids the actual or attempted willful damage to property being transported in interstate or foreign commerce while such property is in the control of a commercial carrier by rail, motor vehicle, or air. Water transport is not included since offenses involving cargo aboard certain vessels are already proscribed by 18 U.S.C. § 2271 et seq. A judgment of conviction or acquittal on the merits in any state or federal court is a statutory bar to prosecution for the same act(s). See 49 U.S.C. § 80501(b).
