Buffalo Man Indicted On Gun Charge

BUFFALO, N.Y.—U.S. Attorney William J. Hochul, Jr. announced today that a federal grand jury has indicted Darryl Bagby, 32, of Buffalo, NY, on a charge of being a felon in possession of ammunition. The charge carries a
Assistant U.S. Attorney Brendan T. Cullinane, who is handling the case, stated that according to the indictment and a complaint filed earlier, on November 25, 2015, the Erie County Sheriff’s Department executed a search warrant at the defendant’s residence at 116 Bidwell Parkway in Buffalo. Deputies recovered one round of 7.62 X 39 caliber ammunition and one round of 9mm caliber ammunition, more than $19,000 of cash in United States currency, cocaine, a digital scale and other drug paraphernalia. Further investigation determined that some of the ammunition was manufactured in Russia.
The defendant was previously alleged in Court to be a member of the Central Park Gang which operates primarily in the Central Park neighborhood in Buffalo.
Bagby will be arraigned on January 7, 2016 at 10:00 a.m. before U.S. Magistrate Judge Hugh B. Scott.
The indictment is the culmination of an investigation by the Erie County Sheriff’s Department, under the direction of Timothy Howard and the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent in Charge Delano A. Reid, New York Field Division.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
