Statement from Antitrust Division Assistant Attorney General Makan Delrahim on the 2nd Circuit decision in the BMI matter

“Today’s Second Circuit decision highlights the challenges of behavioral consent decrees in antitrust cases.  Such decrees, over time, effectively become perpetual regulations that the Department of Justice and the courts are often not well-suited to enforce,” said Assistant Attorney General Makan Delrahim of the Department’s Antitrust Division.  Mr. Delrahim stated, “we will review the court’s decision and determine the best course of action for competition and the American consumer.”
