Willard K. Tom is a partner at Morgan, Lewis & Bockius, LLP, resident in its Washington, D.C. office.

Will has had more than twenty-five years of experience in the antitrust field, both in private practice and in government, and has been recognized by his peers by a listing in the 2005-2007 editions of THE BEST LAWYERS IN AMERICA.

In government, Will served in several management and policy positions and roles:

  • deputy director of the Bureau of Competition of the Federal Trade Commission
  • head of the Bureau's policy office
  • counselor to the head of the Antitrust Division of the U.S. Department of Justice
  • one of the principal drafters of the DOJ and FTC Antitrust Guidelines for the Licensing of Intellectual Property

Will has also been an active contributor to the bar and legal community. Over the past few years, he served as co-chair of the ABA Antitrust Section's merger process reform task force and as editorial chair of the ABA Antitrust Section's reference work, 2004 ANNUAL REVIEW OF ANTITRUST LAW DEVELOPMENTS. He currently serves as a member of the Antitrust Section's Long-Range Planning Committee and on the Council of the ABA Section of Business Law.

Will has spoken and written on a wide variety of antitrust topics, including, in connection with today's topic, Anticompetitive Aspects of Market-Share Discounts and Other Incentives to Exclusive Dealing, 67 ANTITRUST L.J. 615 (2000).

He received his bachelor's degree, cum laude, from Harvard College in 1975, and his law degree, cum laude, in 1979 from Harvard Law School.
