1115. Sample Indictments

  1. Original Carjacking Offense (from 10/25/92 to 9/12/94)

    The grand jury charges that on or about (date) at [Tampa, Florida] , in the [Middle] District of [Florida] [JOHN DOE] defendant herein, possessing a firearm, did take from the person or presence of another, to wit, (victim) , by force and violence and intimidation, a motor vehicle that had ben transported, shipped, or received in interstate commerce, that is, a 1992 Chevrolet Camaro, all in violation of Title 18, United States Code, Section 2119.

  2. Revised Carjacking Offense (on or after 9/13/94)

    The grand jury charges that on or about (date) at [Tampa, Florida] , in the [Middle] District of [Florida] [JOHN DOE] defendant herein, with the intent to cause death or serious bodily harm, did take from the person or presence of another, to wit, (victim) , by force and violence and intimidation, a motor vehicle that had been transported, shipped, or received in interstate commerce, that is, a 1996 Chevrolet Camaro, all in violation of Title 18, United States Code, Section 2119.
