2016. Federal Mine Safety And Health Act (MSHA)

The Federal Mine Safety and Health Act of 1977 ("MSHA") as amended, 30 U.S.C. § 801 et seq., provides for enforcement of its provisions by means of civil and criminal penalties, 30 U.S.C. § 820, and by other civil and administrative enforcement methods. See, e.g., 30 U.S.C. §  817(a)(withdrawal orders); 30 U.S.C. § 818(injunction). Investigations are carried out by the Mine Safety and Health Administration of the Department of Labor. Complaints of violations should be referred by the United States Attorneys to the Assistant Secretary for Mine Safety and Health, United States Department of Labor, 4015 Wilson Boulevard, Arlington, Virginia 22203 and also to the Fraud Section of the Criminal Division.
