1444. Penalty Provisions For Section 842 Offenses

Pursuant to 18 U.S.C. § 844(a), as amended by the Antiterrorism Act of 1996, at § 604, 110 Stat. at 1289, violations of section 842(a) through 842(i) or 842(l) through 842(o) carry penalties of imprisonment not exceeding ten years, a fine of up to $250,000, or both. See 18 U.S.C. §§  3559(a), 3571.

Pursuant to 18 U.S.C. § 844(b), violations of § 842(j) or (k) are misdemeanors that may be punished by imprisonment for not more than one year. If the misdemeanor resulted in death, a fine of not more than $250,000 is authorized. If the misdemeanor did not result in death, the fine may not exceed $100,000. See 18 U.S.C. §§ 3559(a), 3571.
