OBSTRUCTION OF JUSTICE
(18 U.S.C. § 1512(c)(2))

  1. During all relevant time periods covered by this Information, POOL FISH DISTRIBUTORS, INC., a corporation organized and existing under the laws of the State of Arkansas, was engaged in the production, distribution and sale of feeder goldfish and was located in Lonoke, Arkansas.
  2. POOL FISH DISTRIBUTORS is hereby made a defendant on this charge.
  3. Beginning at least as early as June 19, 2002 and continuing until at least until May 2004, in the Eastern District of Michigan, in the Eastern District of Arkansas and in the Northern District of Ohio, POOL FISH DISTRIBUTORS did corruptly obstruct or impede an official proceeding, specifically a grand jury in the Northern District of Ohio which is investigating allegations of price-fixing, market allocation and other violations of federal law arising in the feeder-goldfish industry, by among other things, intentionally delaying the production of documents that the grand jury subpoenaed and that were material to its investigation or intentionally failing to produce such documents to the grand jury in a timely manner; thereby obstructing or impeding the grand jury's ability to consider the materiality of one or more documents before one or more of the alleged violations became time-barred.
