DEPARTMENT OF JUSTICE ANTITRUST DIVISION UNITED STATES v. DNH INTERNATIONAL SARL, DYNO NOBEL, INC., EL PASO CORP., and COASTAL CHEM, INC. Take notice that a proposed Final Judgment as to DNH International Sarl, Dyno Nobel, Inc., El Paso Corp., and Coastal Chem, Inc., has been filed in a civil antitrust case, United States of America v. DNH International Sarl, Dyno Nobel, Inc., El Paso Corp., and Coastal Chem, Inc., Civil Action No. 1:03CV2486. On December 2, 2003, the United States filed a Complaint alleging that the proposed acquisition by DNH International Sarl subsidiary Dyno Nobel, Inc., of two industrial grade ammonium nitrate production plants owned by El Paso Corporation subsidiary Coastal Chem, Inc., would violate Section 7 of the Clayton Act, 15 U.S.C. § 18. The proposed Final Judgment, filed at the same time as the Complaint, requires Dyno Nobel to divest its interest in a Vineyard, Utah, ammonium nitrate production plant, or, in the alternative and at the direction of the United States, its Battle Mountain, Nevada, ammonium nitrate production facility just acquired from Coastal Chem. A Competitive Impact Statement filed by the United States describes the Complaint, the proposed Final Judgment, the industry, and the remedies available to private litigants who may have been injured by the alleged violation. Copies of the Complaint, proposed Final Judgment and Competitive Impact Statement are available for inspection at the Department of Justice in Washington, D.C. in Suite 215, 325 Seventh Street, N.W., and at the Office of the Clerk of the United States District Court for the District of Columbia, 333 Constitution Avenue, NW, Washington, D.C. 20001.
