[PROPOSED] ORDER

On December 6, 2003, Plaintiff filed a Motion to strike the expert report of Steward C. Myers and preclude defendants from calling him as a witness to testify at trial.

Upon review of the Plaintiffs' Motion and supporting memorandum and the Defendants' response, IT IS HEREBY ORDERED that the expert report of Steward C. Myers is stricken from the record and may not be relied on in any way by any witness. IT IS FURTHER ORDERED that Defendants are precluded from calling Steward C. Myers as a witness at trial.
