Asylum EAD Clock Requests

The EOIR Office of the General Counsel (OGC) handles written inquiries and correction requests relating to the Asylum EAD Clock for individuals whose immigration cases are on appeal either before EOIR’s Board of Immigration Appeals or the U.S. federal circuit courts of appeals. Under the terms of the Garcia Perez, et al. v. USCIS, et al., Final Settlement Agreement upon receipt of a written Asylum EAD Clock request, OGC will respond to these requests within 25 business days, absent exceptional circumstances.

Written requests to adjust EOIR’s Asylum EAD Clock for cases on appeal, should contain the applicant’s name and A number, address, the immigration court that had jurisdiction over the case, whether the case is on appeal at the Board of Immigration Appeals (BIA) or a federal court, as much information as possible as to the case history, the status of the clock, why the requestor believes the clock should be adjusted, and how much time the requestor believes should be on the clock. If the case is on appeal and the Asylum EAD Clock request is accidentally sent to BIA, as a courtesy the request will be forwarded internally to OGC for response. OGC will respond within twenty-five (25) business days following receipt of the forwarded request, absent exceptional circumstances. Please note that Asylum EAD Clock requests received at OGC that do not relate to cases on appeal, as a courtesy will be forwarded to the immigration court with jurisdiction over proceedings. The immigration court will respond within twenty-five (25) business days following receipt of the forwarded request, absent exceptional circumstances.
