1990. Sexual Assault

The offense of assault with intent to commit rape has been eliminated from the Federal assault statute, 18 U.S.C. § 113. Section 113 now specifically excludes from its coverage assault with intent to commit a felony under the sexual abuse statutes. Such conduct may now be charged as an attempt under the appropriate sexual abuse statute.
