1868. Scheduling Of Controlled Substances -- 21 U.S.C. § 812, 813, 802(32)

The Controlled Substances Act scheduled controlled substances and established penalties and controls for each schedule. These schedules are updated on an annual basis and are found at 21 C.F.R. § 1308.11 et seq., as amended by subsequent revisions published in the Federal Register. NOTE: The original schedules, codified at 21 U.S.C. § 812, are not current and should not be relied up by prosecutors.

The Controlled Substance Analogue Enforcement Act, 21 U.S.C. §§  802(32) and 813, provides that unscheduled analogues of controlled substances in Schedules I or II will be treated as controlled substances in Schedule I for purposes of control and prosecution.
