7.8 - Final Agency Order
In cases under INA §§ 274A, 274B, and 274C, the ALJ’s final order becomes the final agency order 60 days after the entry of the order, unless:
- in a case arising under INA § 274A or 274C, the CAHO modifies, vacates, or remands the ALJ’s final order pursuant to 28 C.F.R. § 68.54; or
- in a case arising under INA § 274A, 274B, or 274C, the order is referred to the Attorney General pursuant to 28 C.F.R. § 68.55.
