3.17 - Frivolous Appeals

If it appears to the Board, at any time, that an appeal is filed for an improper purpose or to cause unnecessary delay, the appeal may be dismissed.  See 8 C.F.R. § 1003.1(d)(2)(i)(D).  The filing of a frivolous appeal may be grounds for discipline against a practitioner.  See Part I, Chapter 8.4 (Conduct).
