78. Appeals from the Final Agency Decision

Final decisions include notices of dismissal and termination as well as the decision rendered by the Complaint Adjudication Officer. Complainants will be notified in the letter of decision to dismiss or terminate a complaint, and the letter of the final decision from the Complaint Adjudication Officer, of the complainant's right to:

  1. File an appeal with the Director, Office of Federal Operations, Equal Employment Opportunity Commission, Post Office Box 19848, Washington, D.C. 20036, within 30 calendar days.
     
  2. File a civil action within 90 calendar days after the receipt of the decision.
