4.5 - Motion Briefs

A brief is not required in support of a motion.  See 8 C.F.R. § 1003.23(b)(1)(ii).  However, if a brief is filed, it should accompany the motion and comply with the requirements of Chapters 2.3 (Documents) and 3.18 (Pre-Hearing Briefs).  

A brief filed in opposition to a motion must comply with the filing deadlines for responses.  See Chapter 2.1(b) (Timing of Submissions).
