4.11 - Non-Opposition to Motion

A motion will be deemed unopposed unless the opposing party responds within 20 days from the date of service of the motion.  See 8 C.F.R. § 1003.2(g)(3).  However, the opposing party’s failure to oppose a motion, or affirmative non-opposition to a motion, will not necessarily result in a grant of that motion.  See Chapter 3.12 (Non-Opposition to Appeal).
